Drug Laws in New Jersey
In New Jersey, there is a long list of drugs classified as controlled dangerous substances (CDS). There are different categories of CDS drugs, which classify them according to how dangerous and addictive they are and whether they have any use for medical treatment in the United States. Drug charges are based on these schedules, as well as the amount of the drug and your location when it was found.

The laws governing CDS are complex. Some are considered completely illegal to possess or use in any form, while others are legal to possess or distribute if you have a prescription. Marijuana is still illegal under federal law but may be used for medical reasons by patients who have a prescription. - Possession: Possession of a CDS may be illegal or require a prescription. The amount and type of CDS alleged to be in your possession will be a factor in the penalties you face. For example, possession of cocaine or heroin in New Jersey is a third-degree felony with up to five years of prison and fines of up to $35,000.
It is important to note that regardless of your intentions, if you are found in possession of CDS and you were within 500 feet of a public park or 1,000 feet of a school zone, New Jersey law allows for assumption of an intent to distribute. Possession with intent to distribute carries higher penalties and prosecutors typically do not have to prove that any sale took place.
- Possession of Drug Paraphernalia: This is a serious charge on its own and qualifies as a disorderly conduct offense in New Jersey. You can be charged for possessing drug-related equipment even if you had no actual drugs in your possession. Drug paraphernalia includes syringes, rolling papers, plastic bags, prescription pads, and marijuana pipes.
- Distribution: This refers to the selling of or intent to sell drugs and is based either on the amount of drugs in your possession, other items in your possession, and your actions and behavior.
- Trafficking: Possession of larger amounts of drugs and/or crossing state lines can result in federal charges of drug trafficking. Penalties for drug trafficking are higher than those for distribution.
- Manufacturing: Cultivation or manufacturing of a CDS is illegal in New Jersey and under federal law. Conviction of manufacturing a controlled substance can result in fines, jail time, having to register as a drug offender, and mandatory rehabilitation.
